Terms & Conditions

1. Eligibility
  • The contest is open to artists of all nationalities, genders, and ages. The contest welcomes both professional and amateur artists. There are no restrictions on artist participation.

2. Submission Guidelines
  • Submission Method: All submissions must be made via the 'Art Contest Entry Form' by the specified time given via Instagram posts or what is referenced on the entry form. All dates and times are in CST. 

  • ​Digital Submissions:

    • Formats: JPEG, PNG, or PDF.

    • Resolution: Minimum of 300 DPI.

    • File Size: Maximum 10MB.

    • File Naming: Please name your files using the format: [ArtistName_Title_2024].

  • Physical Artwork

    • Photograph your artwork in a clear, well-lit space. The photo should be taken in an empty space with no recognizable brands or faces visible. Ensure the artwork is centered and in focus, and avoid using filters or editing tools that alter its appearance.

    • Physical artwork does not need to be mailed in; only the photo submission is required.

3. Selection Process
  • Review Process:

    • Entries will undergo an unbiased and thorough review based on creativity, composition, emotional impact, artist statement, adherence to the theme, technical skill, and color usage. The exact scoring guide remains confidential.

  • Timeline:

    • Review Period: Submissions are reviewed continuously as they are received.

    • Notification: Winners will be contacted via email before any public announcement. Winners will receive a prize confirmation email and are expected to respond within 3 business days or else they relinquish their claim to winning prizes.

    • Public Announcement: Winners will be announced on social media (@professional_deaf_asian) during the last week of the month.

  • Conflict of Interest:

    • Measures are in place to avoid conflicts of interest in the judging process.

  • Feedback:

    • Due to the high volume of entries, individual feedback will not be provided. General feedback may be shared after the contest concludes.

4. Prizes
  • Prize Details:

    • Prizes are subject to change from contest to contest based on available funding and are non-transferable.

  • Charity Option:

    • Winners have the option to donate their prize to a charity of their choice. If a winner elects this option, a receipt of the donation can be provided upon request.

  • Prize Distribution:

    • Details regarding the distribution of prizes will be provided to winners via email. Winners must confirm their prize choice and provide any necessary information within 3 business days of receiving the notification.

  • Public Acknowledgment:

    • Winners will be acknowledged publicly, including on my social media platforms, unless otherwise requested.

5. Withdrawal and Disqualification
  • Withdrawal of Submissions:

    • Artists may withdraw submissions by contacting pdaofficialartcontest@gmail.com before the submission deadline. Withdrawals are not accepted after the deadline.

  • Disqualification:

    • Entries may be disqualified for failing to comply with contest rules or if found to be plagiarized. AI-generated art is not accepted and will lead to automatic disqualification. Disqualified entries will not be considered, and the decision is final.

  • Notification of Disqualification:

    • Artists whose submissions are disqualified will be notified via email. If disqualified, entries will not be eligible for resubmission.

6. Intellectual Property Rights
  • Ownership:

    • Artists retain full ownership of their artwork. Participation in the contest does not transfer ownership rights to Forest Shipp.

  • Usage Rights:

    • By entering, artists grant Forest Shipp a non-exclusive, royalty-free license to use, reproduce, and display the artwork for contest-related promotional purposes. This includes marketing materials, social media, and exhibition. The license does not cover commercial exploitation beyond the contest.

  • Attribution:

    • Whenever the artwork is used for promotional purposes, Forest Shipp will provide appropriate credit to the artist.

  • Modification:

    • Minor adjustments (such as cropping or resizing) may be made to preserve the artwork's integrity. Major modifications will not occur without consent.

    Withdrawal of Rights:

    • Artists may withdraw consent by providing written notice to pdaofficialartcontest@gmail.com. Forest Shipp will cease new promotional use but is not required to remove the artwork from existing materials.

    Third-Party Use:

    • Forest Shipp may sublicense or transfer the rights to third parties for the purposes of contest-related promotions and exhibitions.

7. Legal Compliance
  • Governing Law:

    • The contest is governed by the laws of the State of Missouri.

  • Dispute Resolution:

    • Any disputes arising from or related to the contest shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, or through litigation in the courts of Missouri, if arbitration is not applicable or enforceable.

  • Liability:

    • Forest Shipp is not responsible for any technical issues, including but not limited to, problems with online submissions or technical malfunctions. Forest Shipp also assumes no liability for any lost, late, or misdirected entries.

  • Compliance with Laws:

    • Participants agree to comply with all applicable local, state, and federal laws and regulations. The contest is void where prohibited by law.

  • Force Majeure:

    • Forest Shipp is not responsible for any failure to perform its obligations under these terms if such failure is caused by events beyond its reasonable control, including but not limited to, natural disasters, acts of war, or government regulations.

  • Severability:

    • If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

  • Modification:

    • Forest Shipp reserves the right to modify or amend these terms and conditions as necessary, and will notify participants of any changes through the contest website or social media platforms.

8. Privacy Policy
  • Use of Personal Information:

    • Personal information collected during the contest will be used solely for the purpose of contest administration, including the processing of entries, communication with participants, and prize distribution.

  • Data Protection:

    • Confidentiality: All personal data will be kept confidential and will not be shared with third parties, except as necessary for the administration of the contest (e.g., contacting winners).

    • No Sale or Distribution: Personal information will not be sold, reproduced, or distributed to any third parties for any purpose other than those stated above.

    Data Security:

    • Reasonable measures are implemented to protect personal data.

    Access and Correction:

    • Participants have the right to access their personal information and request corrections if needed. Requests can be made by contacting pdaofficialartcontest@gmail.com.

  • Data Retention:

    • Personal information will be retained only for as long as necessary to fulfill the purposes of the contest and in compliance with applicable laws and regulations.

  • Changes to Policy:

    • Any changes to this privacy policy will be communicated to participants through the contest website or social media platforms. Participants are encouraged to review the privacy policy periodically.

9. Amendments
  • Right to Amend:

    • Forest Shipp reserves the right to amend or update the terms and conditions of the contest at any time.

  • Notification of Changes:

    • Any amendments to the terms and conditions will be communicated to participants through updates on the website.

  • Effective Date:

    • Changes to the terms and conditions will become effective as of the date of the update. Participants are responsible for reviewing the terms and conditions regularly to stay informed of any changes.

  • Impact of Amendments:

    • Amendments may affect the contest rules, eligibility, submission guidelines, and other aspects of the contest. By continuing to participate in the contest after any amendments have been made, participants agree to the updated terms and conditions.

  • Previous Terms:

    • Any prior versions of the terms and conditions will no longer be valid once amendments are made and communicated.

Usage Agreement

1. Grant of Rights
  • License Grant:

    • By entering the contest, participants grant Forest Shipp a non-exclusive, royalty-free license to use, reproduce, and display the submitted artwork for promotional purposes related to the contest. This includes, but is not limited to, use in marketing materials, social media, websites, and exhibition of contest entries.

  • Purpose of Use:

    • The license granted is specifically for purposes related to the promotion, reporting, and evaluation of the contest. Forest Shipp may use the artwork to publicize the contest, showcase entries, and feature winners.

  • Attribution:

    • Appropriate credit will be provided to the artist for promotional use.

  • Modification:

    • Minor adjustments may be made to maintain the integrity of the artwork. Major modifications require consent.

  • Term of License:

    • The license is granted for the duration of the contest and for a reasonable period thereafter for promotional purposes. The artwork may continue to be used in contest-related materials even after the contest concludes, unless the artist requests removal.

  • No Transfer:

    • The license granted is non-transferable and does not grant any rights beyond those stated above. Forest Shipp does not have the right to sublicense or transfer these rights to third parties, except as necessary for the promotion of the contest.

  • Withdrawal of Rights:

    • If an artist wishes to withdraw their consent for the use of their artwork, they may do so by providing written notice to pdaofficialartcontest@gmail.com. Forest Shipp will cease using the artwork in new promotional materials upon receipt of such notice, but will not be required to remove the artwork from materials already in circulation.

2. Attribution
  • Forest Shipp will provide appropriate credit to the artist whenever the artwork is used in promotional materials.

3. Commercial Use
  • The artwork may be displayed in commercial materials such as this website. Artists will not receive additional compensation beyond the contest prizes.

4. Modification
  • Minor modifications may be made for promotional purposes while maintaining the artwork's integrity. Major modifications are unlikely.

5. Third-Party Rights
  • Forest Shipp will not sublicense or transfer usage rights to third parties for the purposes of promotion and exhibition.

6. Duration and Termination
  • Usage rights remain in effect for at least one year from the winners' announcement. Artists can request withdrawal from future use by contacting pdaofficialartcontest@gmail.com.

7. Reproduction and Exhibition
  • The artwork may be reproduced in contest-related materials and exhibited online and in physical locations associated with the contest.

8. Compensation
  • No additional compensation will be provided for the usage of the artwork beyond the contest prizes.

9. Withdrawal of Rights
  • Artists may withdraw their consent for the use of their artwork by contacting pdaofficialartcontest@gmail.com. Forest Shipp will cease using the artwork upon receipt of such request.
